Deputies have made an arrest in a drive-by shooting that left a bystander dead at a home near Osuna and Edith NE last week.
Christopher Montoya, 26, is charged with an open count of murder and two counts of tampering with evidence in the Nov. 19 killing of 36-year-old Elizabeth Martinez.
Montoya was booked into the Metropolitan Detention Center on Friday. It is unclear whether he has an attorney, and his family did not wish to comment.
Albuquerque Arrests
According to a criminal complaint filed in Metropolitan Court:
Bernalillo County deputies responded around 8:30 p.m. to a shooting at a home in the 6400 block of Franciscan NE. A woman flagged them down and led them inside a home, where Martinez was fatally wounded. She died at the scene.
Deputies discovered bullet holes in the walls of the house and found at least one 9mm bullet casing outside near some tire marks. A man inside the home told deputies a friend of his had brought a car to the house, along with some “dope” that he was interested in buying.
The man said the friend, a woman, brought another man with her and the two men got into an argument. The man told deputies he fired a “warning shot” in the air to scare the man off but, soon after that, several bullets came through the windows and walls of the house, striking Martinez.
Deputies found the car abandoned down the road from the house, with 9mm casings inside, but managed to track down the woman involved and she identified the shooter as Montoya. The woman told deputies she brought Montoya with her to the house before her friend got into an argument with him.
The woman said the man fired the warning shot and, as they were leaving, Montoya fired several times at the house before driving away. Deputies detained Montoya and he initially denied being with the woman or involved in the incident in any way.
When detectives pressed him on why his phone GPS put him at the scene, Montoya said he left his phone in a car “and someone drove it there.” Eventually, Montoya told deputies he delivered the car to the woman, but only dropped it off with her and did not see it again.
Detectives pulled the woman’s phone records, and found messages between her and Montoya discussing the sale of the car and him leaving her at the house before the shots were fired.
Inside Montoya’s home, deputies found 9mm bullets and a holster, but no gun.
